...Buchanan on Justice at Marx...

  • Following Hegel distinguish objective and subjective freedom, former require an object (good behaviour.  Modern state combines both through civil society.  Consciousness of the freedom requires an immediate object - property.  Private property - "the immediate embodiment which freedom gives itself in an immediate way...  For a person by distinguishing himself for himself distinguishes himself from others, and it is only as owners that two people exist for each other" (Hegel, Philosophy of Right).  I.e. consciousness of oneself as a person via the others, which takes form of their recognition as owner.  AP: wtf...   Property thus is Aufhebung of the pure subjectivity, in property a person for the first time exists as reason.  
  • But to keep "extravagances" of the individual freedom there is a need of power - this cannot be a member - to combine a bourjois and citoyen - return to a schizophrenia.  Marx does not value civil society for its freedom is a slavery (Holly Family) - contrary to Hegel for which this structure of civil society giving way to personal freedom within the frameworks of the laws laid down by the government (elite) allows this coexistence (even "unification") of the objective and subjective freedom.  civil society is a sphere of "abstract right" based on the paradigm of exchange.  
  • But both Hegel and Marx did not accept unrestricted "right to private property".  AP: and this is not "private property right" - the idea is that the "right to" is a sphere of the law, thus public in nature, does not deal with the content of the property but regulates how the the owner enters social relationships.  
  •  Exchange = mutual alienation.
